1. Tahir Corporates Pty Ltd A.C.N. 677 972 708 trading as Mobis Rentals (Mobis) hires the Vehicle to the Driver for the period stated in the Hire section.
2. Mobis warrants that the Vehicle:
3. Is roadworthy and properly registered in accordance with the standards in Victoria.
4. Accessories are in working order, except for those stated in the condition report.
5. Is free from any type of damage, except for those stated in the condition report.
6. The Driver may use the Vehicle for commercial purposes.
7. The Driver will pay Mobis the Bond, and any Charges arising from this contract on signing, and any other Charge at the end of the Hire or any other date required by Mobis.
8. The Driver warrants the Driver has a valid driver’s license.
9. The Driver agrees with the Condition Report provided by Mobis at the commencement of the Hire.
10. During the period of Hire, the Driver agrees that the Driver will:
11. Always comply with the laws of Victoria and conditions of any driver’s license.
12. Be the exclusive driver of the Vehicle.
13. Use the Vehicle only in the State of Victoria.
14. Ensure that all email and other text-based communications from Mobis can always be received by the Driver during the Hire and read.
15. Always keep the Vehicle tidy, clean and hygienic.
16. Report, in writing/photographs/video, any damage to the Vehicle to Mobis.
17. Repair any damage to tyres and wheels including punctures at the Driver’s expense.
18. Use the correct fuel type applicable to the Vehicle and use any incorrect fuel replacement facilities provided by a service station at the Driver’s expense.
19. Service the Vehicle by a mechanic authorised by Mobis when a service falls due, whether the due date is specified on the windshield sticker or advised by Mobis in writing.
20. In the event of an accident, the Driver will:
21. Use best endeavours to ascertain details of any other driver involved or any witness.
22. Not admit or deny liability for the accident.
23. Pay Mobis any Insurance Excess amount when required by Mobis.
24. Fully co-operate with Mobis or its insurer.
25. Report any Vehicle breakdown to Mobis and use and comply with the Roadside Assistance service provided by Mobis.
26. Will permit Mobis to inspect the vehicle when requested by Mobis.
27. Wholly indemnify Mobis for any damages arising from acts of negligence or other tort on the Driver’s part.
28. If the Vehicle is not returned as agreed, the Driver permits Mobis to report the Vehicle to the Police as a ‘stolen’ vehicle.
29. Accede to all reasonable requests by Mobis.
30. The Driver will return the Vehicle to Mobis at the end of the Hire during business hours:
31. In the same working condition as the Driver received the Vehicle at the commencement of the Hire, fair wear and tear excepted.
32. To the Return Location or other place specified by Mobis with a full fuel tank.
33. Mobis may:
34. discard any belongings left in any Vehicle.
35. At any reasonable cost charged to the Driver, Completely fill the fuel tank or have the Vehicle cleaned and repaired (if required).
36. Directly debit any account held by the Driver for any Charge.
37. Pursue the Driver, at the Driver’s expense, for any outstanding Charge including reporting the Charge as a debt to any credit reporting agency or for debt recovery and litigation.
38. The Driver authorises Mobis to:
39. Retain information in this document, any other supplied information and use and disclose that information for:
40. One or more direct debits to any authorised deposit-taking institution as defined in the Banking Act 1959 (Cth).
41. Any debt recovery and litigation.
42. Credit agency reporting of any defaults.
43. Registration of a charge or security.
44. Any type of investigation for any offence, nomination of a fine, levy, toll or claim.
45. Obtain information from any Commonwealth or State government department, agency or authority as to only the Driver’s registered address and this clause constitutes the Driver’s express permission for Mobis to obtain such information.
46. Forfeit and apply the Bond, or any part of it, to any Charge.
47. Nominate the Driver for any traffic offence during the Hire in relation to the Vehicle.
48. Deduct any Charge from the account stated in the Payments section.
49. Use, in any way, remote monitoring, tracking and remote immobilisation systems for the Vehicle that Mobis in its absolute discretion requires.
50. In the event of a default:
51. Retrieve the Vehicle and any fees or costs associated with the retrieval is a Charge.
52. Lodge a Caveat or register a charge over any real property in Australia owned by the Driver for any outstanding Charge.
53. Use the Emergency Contact stated above to contact the Driver.
54. The Driver further agrees:
55. Advise Mobis, in writing, of any update to the Driver’s address or Payment Information or the Driver’s whereabouts, if requested by Mobis.
56. For Mobis to use and disclose, confidential and private information, to another party for the purposes of giving effect to or enforcing this contract.
57. That any notice required to be served on the Driver by virtue of this contract may be made
58. to the Email address or Mobile stated above, or any text-based messaging system or social media platform in which the Driver has a presence or upon the Emergency Contact stated above.
59. That any overdue amounts attract penalty interest at the rate specified by the Penalty Interest Rates Act 1983 (Victoria) and is a Charge.
60. To do anything required by Mobis to give effect to this Contract.
61. To submit to the jurisdiction of the State of Victoria and the laws of that state.
62. This contract binds the Driver’s heirs, executors, successors, administrators, trustees and lawful assigns.
63. Insofar as any provision contained or referred to in this contract may be contrary to anything contained in any convention, statute, mandatory law, government regulations, orders or requirements which cannot be waived by agreement of the parties, that provision will remain applicable to the extent that it is not overridden thereby or contrary thereto.
64. Amounts stated herein are inclusive of GST.
65. These conditions are subject to any special conditions.

Charge means an amount of money that may be any one or more of the following, as determined by Mobis:

1. The Daily rate, including any unpaid amount, and where the vehicle is not returned to Mobis on the End Date for any reason, the Daily Rate will apply at twice the amount stated above.
2. Late fees of $50 for every week a payment is overdue.
3. The amount of Excess for insurance, as applicable.
4. If the Driver does not have a toll account and toll charges apply, $50 for each nomination.
5. Vehicle Service costs during the Hire. If the Driver fails to service the Vehicle during the Hire, $100 for every additional 500 kilometres driven.
6. Cleaning and repair costs, including wheel/tyre damage, for the Vehicle except for damages in the Condition Report.
7. Costs of replacing for unreturned keys/smartkeys.
8. Costs and fees incurred by Mobis because of any default of this contract.
